Merch.link prints what sellers upload, so we need every design to be theirs to sell and within the rules below. This policy is part of our Terms of Service and Seller Agreement.

What you can upload

Only upload designs, names, logos and images that you created or have permission to use. Don't upload:

  • Someone else's artwork, photos, logos, trademarks or band names without permission
  • Content that shows or promotes hate, harassment or violence against people or groups
  • Sexually explicit content, or any sexual content involving minors
  • Content that promotes illegal activity, or that is defamatory or invades someone's privacy

We may review designs before or after they go live, and we may decline or remove anything that breaks this policy.

Reporting copyright infringement (DMCA notice)

If you believe something on Merch.link infringes your copyright, send a notice to our designated agent with:

  1. Your physical or electronic signature.
  2. A description of the copyrighted work you believe is infringed.
  3. The URL of each store or item you want removed.
  4. Your name, address, phone number and email.
  5. A statement that you have a good-faith belief the use isn't authorized by the copyright owner, its agent or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for them.

Designated agent: [DMCA designated agent name], [Legal entity name], [DMCA agent mailing address]. Email: dmca@merch.link.

When we receive a complete notice, we remove or disable the item and tell the seller. For trademark or other rights, email the same address with the details and we'll review it.

Counter-notice

If you're a seller and believe your item was removed by mistake or misidentification, send our agent a counter-notice with:

  1. Your physical or electronic signature.
  2. The item that was removed and the URL where it appeared.
  3. A statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal court for your address (or, outside the U.S., any judicial district where Merch.link may be found), and that you'll accept service of process from the person who sent the original notice.

We'll forward the counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they've filed a court action, we may restore the item 10–14 business days after we receive the counter-notice.

Repeat infringers

We close the stores of sellers who repeatedly infringe others' rights.

Misuse

Knowingly sending a false notice or counter-notice can make you liable for damages under the DMCA (17 U.S.C. § 512(f)).
